私人监听目前在我国刑事诉讼中,还是法律所禁止的行为,然而私人监听在一定条件下具有合理性,特别是私人监听资料的证据能力来看,各国的司法实践中都没有完全否定私人监听取得证据的合法性.我国要构建完善的监听制度,也应在一定条件下认可私人监听的合法性.
