近年来,随着我国社会主义市场经济体制的逐步建立和改革的不断深化,社会矛盾纠纷呈现出诸多新情况、新特点,矛盾纠纷的多发性、复杂性和群体性使矛盾纠纷的化解难度越来越大,单一的调解制度已不能适应社会发展的需要。本文通过分析对比人民调解和司法调解的优势与不足,找到人民调解和司法调解之间的互补性。并针对我国人民调解和司法调解的功能优势及其存在的弊端,通过建立:“诉前引导”对接机制、“诉中委托、参与调解”对接机制、诉后联动对接机制、联合调解机制以及人民调解协议的司法确认机制,实现人民调解与司法调解的制度优化及资源整合,进一步发挥其功能优势,实现功能互补、资源共享,达到人民调解和司法调解的有机衔接。为有效化解社会矛盾纠纷、维护社会和谐稳定,促进经济社会发展提供重要保障。
