本文从我国加入WTO后法学教育所面临的国际化、法律服务全球化挑战的大背景出发,以国际性的视角,探讨了我国法学教育中的教育目标、教学方法等问题,以求完善和发展我国的法学教育制度。全文共分四个部分。第一部分:阐述了WTO项下的义务,即建立一支高素质的行政、司法人员队伍的必要性,由此引出我国高等法学教育在这样的历史背景下,所承担的法律人才培养的重任。第二部分:详细分析了入世之后开放的服务贸易市场就我国人才素质提出的挑战,以及由此而使我国现行法律教育制度在教育职能、管理体制、课程体系设置、法学教育模式和人才综合素质等方面所存在的问题与不足。第三部分:从国际性比较研究的角度,在介绍与借鉴其他国家做法的基础上,结合我国的实际情况,提出了我国法学教育如何应对国际化挑战的对策。第四部分:通过简略回顾我国法学教育发展的历史,展望国际社会现代法学教育发展的趋势,提出我国法学教育应通过更加开放的国际交流办学的模式培养国际化的法律人才,使我国法学教育能与时俱进,顺应国际经济迅速发展的趋势与潮流。
This article starts from the background of internationalization and legal service globalization challenge that law education faces after China’s accession to WTO, probes into the educational goals, teaching methods and other issues in the legal education of our country from an international perspective in order to improve and develop China’s Law Education System. The full text is divided into four parts. The first part expounds the obligations under WTO, that is, the necessity of establishing a contingent of highly qualified administrative and judicial personnel, which leads to the important task of training legal professionals under the historical background of our country’s higher law education. The second part analyzes in detail the challenges posed by the open service trade market after joining the WTO to the quality of our country’s qualified personnel, and thus the current legal education system in our country has a lot of problems in the fields of education function, management system, curriculum system, legal education mode and comprehensive quality And other aspects of the problems and shortcomings. The third part: From the perspective of international comparative studies, based on the introduction and reference of other countries’ practices, combined with the actual situation in our country, this paper puts forward some countermeasures to how our country’s legal education can meet the challenge of internationalization. Part IV: By briefly reviewing the history of the development of legal education in our country and looking forward to the trend of the development of modern legal education in the international community, we propose that our legal education should cultivate international legal talents through a more open model of international exchange and education so that our legal education can Keep pace with the times and comply with the trend and trend of rapid international economic development.
