意大利刑事诉讼在历史上是典型的职权主义模式,1989年意大利大力借鉴美国的对抗制修改《刑事诉讼法》使之成为混合模式的代表。但是Knox案引发了美国对意大利刑事诉讼的诸多质疑,包括允许多种诉讼并存同一审判、公诉人使用品格证据、法庭不隔离陪审团、法官在判决意见中假设犯罪动机等。我国刑事诉讼的演进路径与意大利相似,Knox案在美国的争议有助于加强对意大利混合制和美国对抗制之差异的了解,进而有助于对我国以审判为中心的司法改革有所启迪。
Italy’s criminal procedure has historically been a typical mode of power. In 1989, Italy made great efforts to learn from the U.S. antagonistic system to amend the Criminal Procedure Law to make it a representative of the mixed mode. However, the Knox case triggered many doubts about the U.S. criminal prosecution in Italy, including allowing multiple proceedings to coexist in the same trial, prosecutors using evidence of character, not isolating jury tribunals, and presuming criminal motives in judgment opinions. Similar to Italy, the controversy over the Knox case in the United States helps to strengthen the understanding of the differences between the Italian hybrid system and the American antagonism system, and thus helps to illuminate the judiciary-centered judicial reform in our country.
