因成文法的滞后性、抽象性、原则性等问题,当前司法裁判中存在相同或者相似的案件得出不同的裁判结果,有可能加剧社会公众对司法机关的信仰危机,而指导性案例能弥补成文法的不足,提高法官的法律适用能力,促进法律适用的统一。法律作为社会控制的工具,其最根本的要求是要服务于社会大众,法律仅仅是社会主体实现自身价值的手段而不是目的;司法工作必须要有社会各界的支持和理解,民众的需求是法院不断发展的源泉与动力,因此具有中国特色的案例指导制度的建立亦应当体现司法的大众化特征。
