一、引言中国法律理论的探索,自七八年三中全会以来,渐次恢复,主要的支持,来自政治。共产党在邓小平的领导下回顾过去三十年来的政治发展,首次公开对法律作出了正面的评价,认为法律在社会主义过渡时期将会担当着重要的角色。法律及法律制度不但被推许为发扬民主,维护政治上安定团结的基石,党更进一步表明,法律是推行社会主义建设最有效的途径。十年动乱以后,法律亦逐渐取代政治斗争,成为解决社会矛盾的合法方法。为此党实行全面的法律改革,谋求在中国建立一个法律秩序,这推动了法律的研究,法学的发展。二、法律探索的泉源——邓小平的法律观邓小平对法律的见解,是中国法学研究理论的泉源。特别是在法律研究起步的阶段,邓
I. Introduction The exploration of Chinese legal theory has gradually recovered since the Third Plenary Session of 1978, and its main support comes from politics.
