一直以来,金融消费者保护都是金融监管的目标与核心内容,为各国政府和监管机关所重视。次贷危机的发生,更反映了金融消费者保护的重要性,引发了各国监管机关和学术界的诸多关注。以往的研究都将目光集中在如何在各国国内开展金融消费者保护,然而,金融全球化进程的加快,金融消费者跨境投资的逐渐增多,国际金融监管合作的日益频繁,都向金融消费者保护提出了新的挑战,同时也反映出当前金融消费者保护迫切需要各国在国际层面的协调与合作。本文正是从这个角度出发,分析了当前金融消费者保护国际合作的不足与困境,指出国际合作仍然存在广阔的发展空间,在此基础上,从参与主体、协调方式等方面提出了一些建议。
All along, the financial consumer protection is the goal and core content of financial regulation, which is valued by governments and regulatory authorities of all countries. The occurrence of the subprime mortgage crisis has even reflected the importance of the protection of financial consumers and has drawn much attention from regulators and academics in various countries. However, the progress of financial globalization, the gradual increase of cross-border investment by financial consumers and the increasing frequent international financial supervision and cooperation, all of these researches have been conducted to financial consumers Protection poses new challenges. It also reflects the urgent need for the coordination and cooperation of all countries at the international level for the current protection of financial consumers. From this point of view, this article analyzes the shortcomings and predicament of international financial protection for international financial cooperation. It points out that international cooperation still has a broad space for development. Based on this, some suggestions are put forward from the aspects of participant and coordination.
