刑事诉讼与刑事辩护密切相关,刑事辩护的功能的实现直接关系到刑事诉讼价值、目的的实现。要实现刑事辩护的功能保障人权需要从立法与司法实践两个方面予以保障。本文从目前刑事辩护的现状出发,探讨刑事辩护在刑事诉讼中的功能和实现所需的条件,以及在新刑事诉讼法即将实施的背景下,对刑事辩护的影响。
