日本的非正规雇佣劳动者与中国的农民工都可以说是经济快速发展的产物。他们在国家的经济发展进程中发挥了巨大的作用。但是在全力保障方面,日本有《计时劳工法》《劳动者派遣法》等很多关于非正规雇佣劳动者的专项法律,在一些基本法当中也有涉及非雇佣劳动者的条文,而中国关于农民工的法律可以说是一个空白。本文旨在通过日本非正规雇用问题的解决方法,探索搜寻保障中国公民工权益的对策。
Japan’s informal hired laborers and China’s migrant workers can all be regarded as the product of rapid economic development. They have played a huge role in the economic development of the country. However, in full protection, Japan has a lot of special laws on non-regular wage-earners, such as the “Time Lapse Labor Law” and the “Workers’ Dispatch Act.” In some basic laws, there are provisions concerning non-wage laborers. In China, Law can be said to be a blank. The purpose of this paper is to explore ways to find ways to protect the rights and interests of Chinese migrant workers through the solution to the problem of informal employment in Japan.
