近年来,由于警察不当开枪,给相对人造成伤亡的案件时有发生,由此引发的社会舆论关注。抛开事件本身的对错的争议,枪支管理与警察开枪行为息息相关,是加强警察部门用枪法律意识的重要一环,不足够重视枪支管理制度的建设,就不能做到事前防范。文章探索警察开枪制度的沿革,以期待从法律上规制警察的开枪制度。
In recent years, cases of casualties caused by relatives have occurred frequently due to improper gun shooting by the police, which has caused public opinion concerns. Disregarding the controversy over the right and wrong of the incident itself, the management of firearms is closely linked with the shooting by the police. It is an important part of strengthening the legal awareness of guns used by the police and can not be prevented in advance if not enough attention is paid to the construction of a firearm management system. The article explores the history of the police shooting system in anticipation of the legal regulation of the police shooting system.
