本文只讨论发生在室内的且门锁无损的杀人案件。对于门、锁无损的杀人案,在实际工作中首先要把与被害人相识的人列入侦察视线。这已是我们常用的和有效的作法。笔者为论证这套作法的可行性及注意的问题,统计并分析研究了36例案件。1990年——1994年长春市内五区共发生杀人案502起,其中发生在被害人住所,而现场入口的房门门锁无损坏的杀人案有36例,占发案总数的7.2%。36例案件已经破获24例,破案率为66.5%。24例案件中罪犯与被害人双向认识(下称双识)的有18例,占75%;罪犯单向认识被害人(下称单识)的有5例,占20.8%;罪犯和被害人陌生(下称陌生)的有1例,占4.2%。从统计数字上看,门、锁无损杀人案双识的概率75%是比较高的,也就是说我们长期以来总结的经验,此类案件侦破从双识人下手的作法是基本正确的,但另外25%概率的存在,也告诫我们非双识人作案的可能性也是不可排除的。这样看问题指导侦破工作才是全面的和正确的,才能避免失误。经考查已破获的24例案件罪犯的行为心理管见如下:
