自2007年《物权法》颁布实施至今已过去5个年头,保护私有财产,维护个人合法权益的现代权属思想在我国有了较大的发展。但是由于我国物权保护的起步较晚,立法技术尚不成熟,建立一套完整的物权立法体系尤其是现实交易操作中的规范性法规极为重要。本文将就不动产物权登记性质这一基本的理论问题进行讨论,以期完善物权登记制度,规范交易程序,确保所有人权益。
Since the Real Estate Law was promulgated and implemented in 2007, five years have passed since the beginning of the 20th century. The idea of modern tenure of protecting private property and safeguarding the legitimate rights and interests of individuals has been greatly developed in our country. However, due to the late start of the protection of property rights in our country, the legislative technology is not yet mature, and it is very important to establish a complete system of property rights legislation, especially the normative laws and regulations in the real trading operation. This article will discuss the basic theory of real property registration, in order to improve the property registration system, standardize the trading procedures and ensure the rights and interests of all.
