房地产的开发是一种特殊的经营活动,而房地产亦属于特殊的商品,因此国家需要对这种特殊商品的生产和交易活动实行全面的管理。对房地产市场的管理是房管机关作为政府的职能部门代表政府意志,依照法律、法规和政策,对城市房屋和从事房屋开发以及经营的行业所进行的管理活动。房地产经营活动参与主体的资格和资质管理、房地产开发项目的审批,实施和交易过程及房地产质量管理等这些均属于房地产市场行政管理的范围。
