第一章 总则 第一条 为保证县级以上人民政府人事部门客观、公正地审理公务员申诉案件,规范办案程序,根据《国家公务员暂行条例》和《国家公务员申诉控告暂行规定》(以下简称《暂行规定》),制定本规则。 第二条 审理公务员申诉案件,坚持有错必纠和依法、及时、适当的原则,做到事实清楚,证据确凿,定性准确,程序合法。 第三条 审理公务员申诉案件,不适用调解原则。受理申诉的机关不得以调解方式结案。 第二章 立案 第四条 对公务员提出的申诉,受理申诉的机关中负责公务员申诉工作的机构(以下简称工作机构)应填写《公务员申诉案件登记表》,
Chapter I General Provisions Article 1 In order to ensure that the personnel department of the people’s government at or above the county level adjudicates objectively and justly the cases of civil servants’ appeals and standardizes handling procedures, according to the Interim Regulations of the State Civil Servants and the Interim Provisions on the Complaints of State Civil Servants (the “Interim Provisions Regulations ”), the enactment of these rules. Article 2 In handling cases of civil servants’ appeals, they should adhere to the principle of being correct and in accordance with the law, timely and appropriate to make the facts clear, the evidence is conclusive, the qualitative and the accurate, and the procedure is legal. The third trial civil case appeal, do not apply the principle of mediation. The authorities accepting appeals shall not conclude the case through mediation. Chapter II Filing of Cases Article 4 Appeals against civil servants and agencies responsible for civil servants’ appeal (hereinafter referred to as “working bodies”) shall fill out the “Civil Service Appeal Case Registration Form”
