2004年6月2日,美国国际贸易委员会初裁认定中国企业生产的无汞碱性电池侵犯了劲量公司有效和可执行的709号专利。6月9日,中国电池协会组织各电池生产企业再次联合上诉,要求美国国际贸易委员会对初裁结果进行全面复审。10月4日,美国国际贸易委员会认定劲量公司709号专利因不具备确定性而无效,从而终止了对中国电池的337调查。10月10日,美国劲量公司向美国联邦巡回上诉法院提起申诉。2006年1月25日,美国联邦巡回上诉法院判决美国劲量公司败诉。
June 2, 2004, the United States International Trade Commission preliminary finding that Chinese enterprises do not produce mercury-free alkaline batteries violated the company’s effective and enforceable Energizer No. 709 patent. On June 9, China Battery Association organized another battery joint appeal by the battery manufacturers, requiring the U.S. International Trade Commission to conduct a comprehensive review of the preliminary ruling. On October 4, the US International Trade Commission concluded that the Ezek 709 patent was invalid due to non-certainty, thus terminating the 337 investigation of China’s batteries. October 10, the United States Energizer filed a complaint to the United States Circuit Court of Appeals. January 25, 2006, the U.S. Federal Circuit Court of Appeals ruled that the United States Energizer failed.
