在证券信用评级取得长足发展的国家中,政府对评级机构的资格认定都制定了相应标准,并通过市场准入制度培育和规范评级市场。本文通过分析国际上的先进法律经验和我国的立法现状,综述了证券信用评级市场准入的国际经验,分析现有市场准入的立法现状和问题,进而从设立监管、认可制度、从业人员资格认定等三个方面对进一步完善我国证券信用评级市场准入制度以及构建证券信用评级市场准入制度的合理框架提出了建议。
In the countries where the credit rating has made great strides, the government has set corresponding standards for the qualification of rating agencies and fostered and regulated the rating market through the market access system. Based on the analysis of the international advanced legal experience and the status quo of our country’s legislation, this article summarizes the international experience of the securities credit rating market access, analyzes the current market access legislation status quo and problems, and then from the establishment of regulatory, accreditation system, practitioners qualifications And other three aspects of the further improvement of China’s securities credit rating market access system and the construction of a securities credit rating market access system, a reasonable framework for the proposal.
