改革开放以来,我国环保立法大发展,但环境状况不断恶化,环保领域的“政府失灵”问题十分突出。对此,上海交通大学环境资源法研究所举办了第二期环境法网上研讨会,围绕“规范和制约有关环境的政府行为”进行了比较深入的探讨。与会学者分析了我国地方政府环保履职的现状、存在的问题及其深层原因,提出了克服地方政府角色多元对环境法实施的不利影响、中国环境法的规范主义进路、解决政府环保履职的激励不足、加强环保主体的互动保障等理论观点;另一方面从具体的制度设计出发,提出了完善干部政绩考核制度、明确环境行政不作为的法律责任、建立政府环境信息公开义务的法律追究机制以及发挥第三方主体的监督作用等建议。这些观点和建议不仅对全国人大正在进行的修改《中华人民共和国环境保护法》的工作具有重要的参考价值,而且给我国环境法学研究带来了新思路和新思考。
Since the reform and opening up, China has made great progress in enacting environmental legislation. However, the environmental situation is deteriorating. The issue of “government failure” in the field of environmental protection is very conspicuous. In response, the Shanghai Jiao Tong University Institute of Environmental Resources Law held a second online seminar on environmental law, focusing on “regulating and controlling environmental government behavior” for a more in-depth discussion. Participants and scholars analyzed the status quo, existing problems and the underlying causes of environmental performance of local government in our country, and put forward some countermeasures to overcome the negative influence of multiple roles of local government on the implementation of environmental law, the normative approach of environmental law in China and the government environmental protection On the other hand, starting from the concrete system design, the paper puts forward some suggestions on how to improve the cadre performance appraisal system, clarify the legal responsibility of environmental administrative omission, and establish the obligation of the government to disclose the environmental information Mechanism and play a supervisory role of the third party and other suggestions. These views and suggestions not only have important reference value for the ongoing work of the NPC on amending the Environmental Protection Law of the People’s Republic of China, but also bring new ideas and new thinking to the study of environmental law in our country.
