意见证据规则无论是在理论还是在实践中,与传闻证据规则、非法证据排除规则等一样都是证据法中一项重要的证据规则。它对于推进诉讼进程与诉讼目的的实现都有很大的影响作用。本文主要借鉴大陆法系与英美法系的一些成熟的经验,意在建立完善的具有中国特色的意见证据规则。具体包括:意见证据审前鉴定结论的开示制度、放宽普通证人意见证据的可采性、严格执行鉴定人出庭原则、鉴定人要接受双方当事人的交叉询问等。
The rules of evidence of evidence, both in theory and in practice, are an important evidence rule of evidence in the same way as hearsay rules and rules of excluding illegal evidences. It plays a very important role in advancing the litigation process and the purpose of litigation. This article mainly draws on some mature experiences of civil law system and Anglo-American law system, and aims to establish a complete rule of opinion evidence with Chinese characteristics. Specifically, it includes the system of preaching the pretrial examination of opinion evidence, the admissibility of the evidence of the ordinary witness, the strict implementation of the appraiser’s appearance in court, and the interviewer’s cross-examination of the parties.
