全面推进社会事业建设、构建社会主义和谐社会是完善社会事业立法的政治背景。社会建设滞后于经济建设、民生问题和社会矛盾日益凸显是完善社会事业立法的社会背景。有关市场经济的法律已经比较完备,但社会事业的立法仍处于比较薄弱的状态,还没有形成比较系统的法律体系,这是完善社会事业立法的法律背景。我国社会事业立法存在立法理念两分化倾向、立法缺乏整体层面的把握、法律空白领域较多等不足,因此,可以通过从根本上转变立法理念,从整体层面完善社会事业立法,加快社会事业重点领域立法进程的基本思路来完善我国的社会事业立法。
