我国是一个海洋大国,海洋生物资源丰富,海洋生物资源保护法律体系的发展经历了漫长的过程,成为海洋法中不可缺少的组成部分。以我国海洋生物资源保护法律体系的历史沿革和现状为研究基点,系统分析我国海洋生物资源保护法律体系存在的问题,在此基础上提出完善我国海洋生物资源保护法律体系的具体措施,即加强海洋生物资源保护专门立法、明确界定海洋生物资源权利的概念和内容、完善相关配套法律法规。
As a big marine country, China has a rich marine life and the development of the legal system for marine living resources protection has undergone a long process and has become an indispensable part of the law of the sea. Based on the historical evolution and current situation of China’s marine biological resources legal system, this paper systematically analyzes the problems existing in the legal system of marine living resources protection in our country, and on the basis of which we put forward the concrete measures to improve the legal system of marine living resources conservation in our country, The special legislation on the protection of biological resources clearly defines the concept and content of the rights to marine living resources and consummates relevant supporting laws and regulations.
