我国当前的法学教育存在着学生法律实务能力低下的严重问题。卓越法律人才培养目标的设定是对当前法学教育现实困境的理性反思。卓越法律人才的培养客观上要求法学教育将塑造学生法律实务能力作为基本要务。作为一种行之有效的实践教学模式,日本临床法学教育以多元化的教学形式和高效的运作评价机制为保障,为培养学生法律实务能力发挥了举足轻重的作用。以日本临床法学教育为鉴,我国的法学教育应围绕塑造学生法律实务能力这一核心目标,着力构建形式多样、运行高效的人才培养模式。
The current legal education in our country has a serious problem of low legal capacity of students. The setting of the goal of cultivating outstanding legal talents is a rational reflection on the current predicament of legal education. The cultivation of outstanding law talents objectively requires that legal education should build students’ ability in legal practice as their basic task. As an effective practice teaching mode, the clinical legal education in Japan is supported by a wide range of teaching methods and an efficient operation evaluation system, which plays an important role in cultivating students’ legal practice ability. Taking Japan’s clinical legal education as a guide, our country’s legal education should center on the core objective of shaping students’ practical ability in law, and strive to build a training model of diverse forms and efficient operation.
