原刑事诉讼法所规定的“正确应用法律,惩罚犯罪分子”单向任务,易导致重实体、轻程序,忽视对犯罪嫌疑人、被告人等诉讼参与人人权的保护,容易引起国际社会误解。2012年新刑事诉讼法设立“正确应用法律,惩罚犯罪分子”和“尊重和保障人权”的双重任务,有利于促进刑事司法公正和实现刑罚特殊预防的目的,增强社会保障观念,从而达至刑事诉讼程序和刑罚减少与控制犯罪的最佳效果。
The “Proper application of law and punishment of criminals” and the “one-way task” stipulated in the original Code of Criminal Procedure can easily lead to the grasping of substantive and light procedures and neglect the protection of the human rights of participants in criminal suspects and defendants. It is easy for the international community misunderstanding. In 2012, the new Code of Criminal Procedure established the dual task of “correctly applying the law, punishing the criminals” and “respecting and safeguarding human rights”, which is conducive to promoting the fairness of the criminal justice and realizing the special purpose of criminal penalties, enhancing the concept of social security, So as to achieve the best effect of criminal procedure and penalty reduction and crime control.
