行政规范性文件在我国目前的行政管理中占据着举足轻重的地位,是行政机关做出行政行为的主要依据之一,但人民法院在对行政行为进行合法性审查时,却不以行政规范性文件为依据。由于对行政规范性文件缺乏有效的监督,导致行政规范性文件存在违反上位法规定,缺乏统一的制定标准,法律地位模糊不清等问题。以对行政法治呼吁和追求,必须加强对行政规范性文件监督。主要通过事前法律保留,事中注重程序加大信息公开、鼓励公众参与,事后附带审查等路径,来保障行政机关依照法定职权和法定程序制定行政规范性文件,避免公民、法人和其他组织的合法权益受到行政权的不法侵害。
