行政规范性文件的现实问题与路径探索

行政规范性文件在我国目前的行政管理中占据着举足轻重的地位,是行政机关做出行政行为的主要依据之一,但人民法院在对行政行为进行合法性审查时,却不以行政规范性文件为依据。由于对行政规范性文件缺乏有效的监督,导致行政规范性文件存在违反上位法规定,缺乏统一的制定标准,法律地位模糊不清等问题。以对行政法治呼吁和追求,必须加强对行政规范性文件监督。主要通过事前法律保留,事中注重程序加大信息公开、鼓励公众参与,事后附带审查等路径,来保障行政机关依照法定职权和法定程序制定行政规范性文件,避免公民、法人和其他组织的合法权益受到行政权的不法侵害。 Administrative normative documents occupy a pivotal position in the current administration of our country, which is one of the main bases for the administrative organs to make administrative acts. However, when the people’s court reviews the legality of administrative acts, it does not take administrative normative documents As the basis. Due to the lack of effective supervision of the normative administrative documents, administrative normative documents have violated the provisions of the upper-level law, lacked uniform standards and obscured legal status. In order to call for and pursue the administrative rule of law, we must strengthen the supervision of administrative normative documents. Mainly through prior legal reservations, focusing on procedures to increase information disclosure, encourage public participation, with a review of the incident and other ways to ensure that administrative organs in accordance with the statutory authorities and statutory procedures for the formulation of administrative normative documents, to avoid the legitimate citizens, legal persons and other organizations Rights and interests are subject to unlawful infringement of administrative rights.
