自《联合国国家及其财产管辖豁免公约》2004年通过以来,国际经济格局发生了诸多变化,随着中国以及中国企业对外的投资规模和投资范围也不断扩大,如何正确理解和利用《联合国国家及其财产管辖豁免公约》,更好地保护本国和本国在国外的利益成为中国必须面临的挑战之一。本文主要从“国家定义”、“商业交易行为的判断”以及“财产的强制执行”三个方面谈谈公约的相关内容以及在新的国际形势下中国的应对策略。
