专利营销策略对技术创新和竞争具有积极意义和负面影响。模仿创新阶段的国家要警惕专利营销策略产生的负面影响,这些具有负面影响的策略主要有专利劫持策略、专利恐吓策略、专利标准化策略和专利布局策略。为维持技术创新的可持续性,建立知识产权预警机制、扶持竞争性的专利联盟、合理限制知识产权请求权的行使、强化强制许可制度和构建合理的专利侵权标准是正确的应对之策。
Patent marketing strategy has positive and negative effects on technological innovation and competition. Countries that imitate the innovation stage should be wary of the negative impact of the patent marketing strategy. The tactics that have a negative impact include the patent hijacking strategy, the patent intimidation strategy, the patent standardization strategy and the patent layout strategy. In order to maintain the sustainability of technological innovation, establishing an early warning mechanism for intellectual property rights, supporting a competitive patent alliance, reasonably restricting the exercise of the right to intellectual property claims, strengthening the system of compulsory licensing and establishing a reasonable standard for patent infringement are the correct countermeasures.
