【案例】 1997年12月,王某经体检、考核合格,与某单位签订了两年期的劳动合同。合同规定试用期为6个月。1998年1月,王某患急性肺炎住院两个月,共花费医疗费5000余元。出院后,单位以王某在试用期内患病,不符合录用条件为由,作出了解除劳动合同的决定,并不予报销医疗费。王某遂向当地的劳动争议仲裁委员会提出申诉。经仲裁,裁决撤销单位解除王某劳动合同的决定:按实际发生额报销王某的医疗费;修订劳动合同约定的试用期限。
【Case】 In December 1997, Wang passed a medical examination and passed the examination. He signed a two-year labor contract with a unit. The contract provides for a probationary period of 6 months.
