第一章总则第一条为了加强和完善企业名称的登记管理,保护企业名称所有人的合法权益,维护公平竞争秩序,根据《企业名称登记管理规定》和有关法律、行政法规,制定本办法。第二条本办法适用于工商行政管理机关登记注册的企业法人和不具有法人资格的企业的名称。第三条企业应当依法选择自己的名称,并申请登记注册。企业自成立之日起享有名称权。第四条各级工商行政管理机关应当依法核准登记企业名称。
Chapter I General Provisions Article 1 These Measures are formulated in accordance with the “Provisions on the Administration of Enterprise Name Registration” and relevant laws and administrative regulations in order to strengthen and improve the registration management of the enterprise name, protect the lawful rights and interests of the owner of the enterprise name and maintain fair competition. Article 2 These Procedures shall apply to the names of the enterprises registered as industrial and commercial administrations and the enterprises not qualified as legal persons. Article 3 An enterprise shall choose its own name according to law and apply for registration. Since the establishment of the enterprise enjoy the name of the right. Article 4 The administrative authorities for industry and commerce at all levels shall approve the names of enterprises registered in accordance with the law.
