英国《2010年能源法》很大程度上体现了社会秩序规则二元观的理念。这种对碳捕获与封存的市场激励与强制社会价格支持机制相结合的制度性设计带给我们的启示是,新能源立法应限定政府对市场的干预仅是提供一种普遍的机会,以发挥市场作为个人、地方制度性设计的主渠道,同时也应确立政府在社会保障方面的首要地位。而所有这些制度性设计得以实现的关键则在于能否完成对新能源发展的过程与手段的制度性安排,以及建立起具有中国语境范式的新能源立法体系。
