律师是刑事诉讼的重要一方,律师的有效参与能保障当事人在刑事诉讼中的合法权益,多数欠缺专业知识的刑事成年犯是需要律师帮助的,但在司法实务中,即使得到法援律师的帮助,倘若法援律师表现不专业,将难以有效保障当事人的合法权益。本文探讨当前刑事成年犯法律援助的制度现状、法律援助在当前刑事成年犯辩护中的实际运行效果、刑事诉讼中的各参与主体如何看待这一项制度。
Lawyers are an important part of criminal proceedings. The effective participation of lawyers can protect the legal rights and interests of the parties involved in criminal proceedings. Most criminal offenders who lack professional knowledge are in need of help from lawyers. However, even with the help of legal aid lawyers in judicial practice, If legal aid lawyers do not perform professionally, it will be difficult to effectively protect the lawful rights and interests of the parties concerned. This article explores the current system of legal aid for criminal criminals in China, the actual effect of legal aid in the defense of current criminal criminals, and how the participants in criminal litigation view this system.
