根据我国《律师执业行为规范(试行)》的规定,国内的律师事务所既不能发布有关价格、质量的信息性广告,也不能发布非信息性广告。这种对律师事务所广告严格规制的做法,值得再探讨。基于法律服务的特点,运用非序贯搜寻模型进行研究,得出的基本结论是:放松律师事务所广告规制,允许其发布有关服务价格、质量等方面的广告,将促进法律服务生产效率、资源配置效率的提高,增进社会福利。研究结果还显示,在均衡状态下,法律服务质量与律师事务所规模正相关。
According to China's “Code of Practice for Lawyers (Trial)”, domestic law firms can neither publish informational advertisements on price and quality nor publish non-informational advertisements. This practice of strict regulation of law firms is worth exploring again.
