《中华人民共和国食品安全法》于2009年6月1日起开始施行。与《食品卫生法》相比,在制度创新方面取得了巨大成就,可以说亮点颇多。但纵观《食品安全法》及一年多来的实施情况,仍有一些不尽科学或者与现代法治的发展趋势不尽相符的地方。拟就《食品安全法》的一些欠缺、不足及如何完善提出自己的看法,以期为我国食品安全法的贯彻与运行抛砖引玉。
The “Food Safety Law of the People’s Republic of China” came into force on June 1, 2009. Compared with the “Food Hygiene Law”, we have made tremendous achievements in institutional innovation, and we can say that there are many bright spots. However, reviewing the “Food Safety Law” and its implementation over the past year or so, there are still some places that are not scientific or that are not in line with the development trend of modern law and order. Proposed “Food Safety Law,” some of the lack of, inadequate and how to improve their own views, with a view to the implementation and operation of China’s food safety law to start with.
