随着商品房外墙面存在潜在或者现实的经济利益,开发商利用商品房买卖契约作出了保留外墙面使用权的约定,本文先明确了外墙面所有权的归属、建筑物区分所有权转让的规定以及外墙面使用的规定等三个方面的问题,此后分析了开发商保留外墙面使用权的效力,并对外墙面的使用提出了几点建议,以便更好地保护全体业主的利益。
With the existence of potential or actual economic benefits on the external walls of commercial houses, developers make use of the contract of sale and purchase of commercial houses to make reservations about the right to use external walls. This article first clarifies the ownership of external walls and the division of ownership of buildings. The provisions of the use of external walls and other three issues, then analyzed the effectiveness of developers to retain the right to use the outer wall, and put forward a few suggestions on the use of the outer wall in order to better protect the interests of all owners.
