国家根本任务乃是立宪者在新时期做出的重要宪法决定,它与宪法的其他根本性内容共同奠定了我国现行法秩序的基础。对于规范宪法学来说,对国家根本任务进行深度解读乃是完成中国宪法体系化作业的必要环节。为了避免对国家根本任务形成孤立化或绝对化的理解,实有必要将之纳入我国宪法的整体脉络中予以界定。与承载着宪法核心价值诉求的国家目的相比,国家根本任务具有手段性和从属性。在规范性质上,国家根本任务乃是我国宪法规范体系内部层次最高的公共利益规定,其与宪法总纲诸条款之间存在着一般与特殊的关系。我国各国家机关在具体化和现实化国家根本任务方面承担着不同的宪法义务。国家根本任务的客观法性质使其无法成为公民主张宪法权利的直接依据。
The fundamental task of the state is an important constitutional decision made by the constitutionalist in the new era. It, together with other fundamental elements of the constitution, has laid the foundation for the present law and order in our country. For normative constitutional law, an in-depth interpretation of the fundamental task of the state is an essential part of the systematic operation of the Chinese constitution. In order to avoid the formation of an isolated or absolute understanding of the fundamental task of the country, it is really necessary to include it in the overall context of our constitution. Compared with the national purpose of carrying the core value of the constitution, the fundamental task of the state is of a kind of means and subordination. In normative nature, the fundamental task of the state is the provision of public interest with the highest level of internal standardization of the constitution in China. There is a general and special relationship between the articles of constitution and the general provisions. The various state organs of our country shoulder different constitutional obligations with regard to the specific tasks of the actualized country. The objective law nature of the fundamental task of the state prevents it from becoming a direct basis for citizens to claim constitutional rights.
