住宅小区公用设施致害案日益增多,依何法律价值判断侵权责任人争议较大,实践案例对公用设施的所有人、管理人或使用人承担责任的依据、责任大小的判决有很大差距,不同地方不同法院有不同的判法。为有效寻求侵权责任人、保护受害人合法权益并获得更好的救济,本文借助几个案例对侵权法的归责原则进行论述,分析当事人的举证责任及抗辩事由,试图运用现有法律对住宅小区公用设施致害深入剥析,以对实践起抛砖引玉之作用。
