在整个工商行政管理法规体系中，有关行政强制措施及行政强制执行措施的法律规范相对于行政处罚来讲较为散、乱，有关的规定也比较简单，而且不同的法律、法规的规定大相径庭，以致给执法活动带来不少不便，也出现不少问题：有的执法人员在使用强制措施时，没有严格审查法律依?
In the entire system of industrial and commercial administration laws and regulations, the legal norms on administrative coercive measures and administrative enforcement measures are relatively scattered and chaotic relative to administrative penalties. The relevant provisions are relatively simple and the laws and regulations of different laws are very different. Brought many inconveniences to the law enforcement activities and many problems appeared. Some law enforcement officials did not strictly examine the law when using coercive measures.
