正当防卫是我国刑法中一项重要的制度,是刑法赋予公民在国家、集体利益、本人或者他人合法权益受到不法侵害时,在不能及时得到公共权力救济时,而采取防卫的权利。正当防卫对于保障国家利益、保护公民的合法权益,具有极其重要的作用。但是,对于正当防卫的合法化根据,究竟是什么,学界有着不同的观点。研究正当防卫的合法化根据及其相关问题,可以为合理司法提供理论依据,同时也可以为现存立法中正当防卫权的正当性寻找依据。
Justifiable defense is an important system in our country’s criminal law. It is the right that the criminal law gives citizens the right to defend when they can not get relief from public authority in time when their legitimate rights and interests are themselves infringed upon by the state or collective or themselves. Proper defense plays an extremely important role in safeguarding the interests of the country and protecting the legitimate rights and interests of citizens. However, what is the legal basis for justifiable defense? The academic circles have different views. Studying the legitimate basis of justifiable defense and its related issues can provide a theoretical basis for a reasonable judicial system and at the same time, it can also provide a basis for justifying the legitimate defense right in existing legislation.
