纠纷解决研究中具有多种视角。其中,社会结构视角是考察在纠纷解决的全部过程中,纠纷的社会结构即纠纷当事人的社会距离、关系距离、社会特征等因素所发生的各种影响。在中国的语境中,纠纷解决的社会结构分析——案件社会学——将考察在纠纷的发生、纠纷解决方式的选择、纠纷解决的过程和结果等现象中,社会结构所发挥的作用和影响。
Dispute resolution research has many perspectives. Among them, the perspective of social structure examines the various influences that occur in the entire process of dispute resolution, such as the social structure of the dispute, that is, the social distance, the relationship distance and social characteristics of the parties involved in the dispute. In the context of China, the analysis of the social structure of dispute resolution - case sociology - examines the role played by social structures in the occurrence of disputes, the choice of methods of dispute resolution, the process and consequences of dispute resolution, and influences.
