因赵作海案促动,5月30日,最高法院、最高检察院、公安部、国家安全部和司法部联合发布了《关于办理死刑案件审查判断证据若干问题的规定》和《关于办理刑事案件排除非法证据若干问题的规定》(下称两个规定)。因为剧烈的权力和利益争议,在官方发布消息和“答记者问”数十日后,两个规定正式文本仍未公开。规则出台的艰难亦是其重要和珍贵的侧证。证据乃司法程序运行的基础,证据规则的良善亦是司法公正的保障。本期我们约请参与这两个证据规则研讨的专家详解此次两个规定的得失,探讨中国刑事证据规则完善的路径,并附一篇介绍美国非法证据排除规则演进的文章,以期为中国刑事法治进步建言。
On May 30, the Supreme Court, the Supreme Procuratorate, the Ministry of Public Security, the Ministry of National Security and the Ministry of Justice jointly promulgated the “Provisions on Several Issues Concerning the Evidence in Handling Death Penalty Cases for Examination and Judgment” and the “Provisions on Handling Criminal Cases Excluding Illegal Evidence of a number of issues ”(hereinafter referred to as the two provisions). Because of the violent controversy over power and interests, the official texts of the two provisions remained open after dozens of official announcements and press questions. The difficult rules are also important and precious side certificates. Evidence is the basis for the operation of judicial proceedings. The goodness of the rules of evidence is also a guarantee of judicial fairness. In this issue, we invite experts who participated in the discussion of the two rules of evidence to explain the pros and cons of the two provisions and explore the path of perfecting China’s criminal evidence rules. We also attach an article introducing the evolution of the exclusionary rules of illegal evidence in the United States, Suggestions for improvement.
