一、与医疗有关的法律应征义务医师法第19条第1款规定:“从事诊疗工作的医师在无正当理由的情况下,不得拒绝诊断治疗的要求”。根据此条款,医师的应征义务不应从诊治对象的角度来理解,而理解成医师作为公法人承担对国家负责的义务较为合适。对于违反上述条款的,虽没有直接的处罚规定,但在医师法第7条第2款规定:“当发生有损医师名誉的行为时,将取消其行医资格,或

Article 19, paragraph 1, of the Law on Compulsory Medical Obligations relating to Medical Treatment stipulates: “A physician engaged in a diagnosis and treatment shall not refuse a request for diagnosis and treatment without justified reasons.” According to this article, the doctor’s application obligation should not be understood from the perspective of the object of diagnosis and treatment, and it is more appropriate to understand that the physician as public legal person assumes responsibility for the country. There are no direct penalties for violations of the above provisions, but Article 2 of Article 7 of the Physician Law states: “When an act that harms the reputation of the physician is to be disqualified, or
