在一个价值日益多元化的社会中,人们对某些问题达成共识的可能性变得越来越渺茫。可以肯定的是,如何限制政府权力、如何协调经济发展和个人财产权保护的争论还将继续下去。物权法无法为社会预设价值衡量的终极结果,但法律可以制订程序。把价值问题转换为程序问题来处理也许是打破政治僵局的一个明智和无奈的选择。通过正当法律程序赋予实体上特定价值判断的正当性,可能成为一条当代社会无可替代的出路。
In a society with increasingly diversified values, people are less likely to reach consensus on certain issues. To be sure, the debate over how to limit government power and how to coordinate economic development with the protection of personal property rights will continue. Property law can not be the ultimate measure of the value of social outcomes, but the law can develop procedures. Translating value issues into procedural issues may be a wise and helpless alternative to breaking a political stalemate. The impartial legal process of giving legitimacy to particular value judgments may become an irreplaceable outlet for contemporary society.
