在我国刑法理论界和司法实践中,故意犯罪中＂着手＂如何界定一直是争议较多的问题。本文浅析了中外对＂着手＂的界定的主观说、客观说及折衷说几种观点,提出了对＂着手＂行为的界定要遵循具体犯意或具体犯罪性质被感知的界定标准。
