法律诊所(Legal Clinic)起源于美国,自1893年,宾夕法尼亚大学法学院的学生成立了1“法律诊疗室”之后,丹佛大学、西北大学、哈佛大学的法学院都组织了类似的诊所。现如今,诊所法律教育模式然被引入中国,它突破了传统的教学方式,将法学教育从“立足教学”引向了“面向社会服务”。华北电力大学法律诊所课程开展至今已是第五期,课程实践和反馈都在向好的方向发展。然而从诊所学生自身的实践状况来看,仍需要做出改进,这都值得诊所师生一起反思以期改善。笔者以华北电力大学法律诊所第五期学生为例,从认识、态度、能力培养三方面来论述法律诊所学生如何能像医生对待病人那样对待委托人。
The Legal Clinic originated in the United States. Similar institutions have been organized by Denver, Northwestern, and Harvard Law Schools since 1893 when law students at the University of Pennsylvania Law School were established. Nowadays, the clinic legal education mode was introduced into China. It broke through the traditional teaching methods and led the legal education from “based on teaching ” to “social service ”. North China Electric Power University legal clinic course has been carried out so far is the fifth period, curriculum and feedback are in a good direction. However, from the clinic students’ own practice status, there is still a need to make improvements, which are all worth reflecting on by clinic teachers and students for improvement. Taking the fifth phase of law clinic of North China Electric Power University as an example, the author discusses how legal clinic students treat clients like doctors treat patients from three aspects: cognition, attitude and ability cultivation.
