由于我国家政公司的经营模式多元化及各地的社会经济水平不一,使得家政工人的工伤保险问题不可能一概而论。因此,“分类施保”是解决家政工人工伤保险的理性之路。目前,《社会保险法》、《工伤保险条例》关于工伤保险制度的规定,对劳动关系不规范的大多数家政工人来说可能难以直接提供有效的法律保护。但是,保险制度本质上是一种风险分担机制,在现行法律制度的框架之下,如果能够将家政工人的工伤责任在家政公司、家政服务员、家政服务消费者及行业组织、政府部门之间进行合理分配,为家政工人提供基本的工伤保障是完全可以实现的。基于以上思路,在此探讨了家政工人工伤保险立法的三种模式(社会保险模式、团体保险模式、政策性保险模式)及其实施路径。
Due to the diversified business models of domestic companies and the different social and economic levels in various places, the issue of industrial injury insurance for domestic workers can not be generalized. Therefore, “classification Shi Bao ” is a rational way to solve the domestic workers injury insurance. Currently, the provisions of the Social Insurance Law and the Work Injury Insurance Ordinance on work-related injury insurance systems may not be able to provide effective legal protection directly to most domestic workers who have irregular labor relations. However, the insurance system is essentially a risk-sharing mechanism. Under the framework of the current legal system, if the liability of domestic workers for work-related injuries can be carried out among domestic companies, domestic workers, domestic service consumers, industrial organizations and government departments Reasonable distribution of domestic workers to provide basic industrial injury protection is entirely achievable. Based on the above ideas, this article explores three modes (social insurance, group insurance and policy insurance) of the legislation on domestic workers’ injury insurance and their implementation.
