当前,在依法依规有效保护房屋被拆迁者权益方面还存在一些问题。在农村房屋拆迁中,法律制度缺失、拆迁补偿未统一法治实践等问题依然存在。而在城市房屋拆迁中,被拆迁者的诸多权利保护立法亟待完善、拆迁补偿安置制度有待进一步完善等问题也较为普遍。党的十八届四中全会开启了全面推进依法治国的历史进程,相应的房屋被拆迁者权益的法律保护也随之进入一个新的发展阶段。基于当前暴露的诸多问题,一些具体的完善举措可以尝试去化解这些难题,比如健全与完善相关法律依据、明确界定政府部门的法定角色和职能等。
At present, there are still some problems concerning the effective protection of the rights and interests of demolished houses according to law. In the process of house demolition in rural areas, there are still some problems such as the lack of legal system and the fact that demolition compensation does not unify the practice of the rule of law. In urban housing demolition, many rights protection legislation of demolished people need to be perfected, and the system of compensation and resettlement of relocation needs to be further perfected. The Fourth Plenary Session of the 18th CPC Central Committee has started the historical process of promoting the rule of law in an all-round way. The corresponding legal protection of the rights and interests of demolished houses has also entered a new stage of development. Based on the many problems currently exposed, some concrete measures for improvement can try to resolve these problems, such as improving and improving relevant legal bases and clearly defining the legal roles and functions of government departments.
