“区别对待”作为台湾地区“司法院”在实务中创设出来的处理两岸人民案件的准则,其形成与确立、扩大适用与突破是通过一系列“大法官解释”实现的。最新的“释字第712号解释”完成了涉及大陆人民法律地位解释逻辑路径从“区别对待”到比例原则的转变。这种转变是多种因素综合作用的结果,对“大法官解释”谱系、大陆人民在台权益乃至两岸关系有着深远的影响。
