当前的金融危机暴露出传统的监管方法对影响金融市场稳定的两个深层原因——金融机构管理成本过高及金融创新过度问题缺乏应对。笔者以为,对于金融机构管理成本,应当由法律明确最高限额。同时,为维护金融市场的稳定,金融创新应当适度。金融监管的理想状态应是防患于未然,监管机构应设身处地地从投资者角度分析市场,以便及时进行风险提示。
The current financial crisis reveals that the traditional regulatory approach lacks two deep reasons for the stability of financial markets: the high management costs of financial institutions and the excessive financial innovation. The author believes that the cost of management of financial institutions, the law should be clearly the maximum amount. In the meantime, financial innovation should be modest in order to maintain the stability of financial markets. The ideal state of financial regulation should be preventive measures, regulators should put themselves in the market from the perspective of investors, in order to timely risk warning.
