专利是技术、法律、经济三位一体的知识产权保护方式,对专利权人的正当权益提供保护。专利对其拥有者在独占技术和占领市场方面发挥着重要作用。因此专利战略是基于上述特点的对新技术引进、开发和占领国内外市场的总体战略和政策上的思考和规划。专利情报战略是实施专利战略的核心,与科研开发、专利管理、生产经营密切相关,专利情报、狭义地讲,指的就是专利文献。与一般技术文献相比,专利文献还可以提供企业研究、开发方针及其成果的经营情报、新产品即将问世的未来情报及有关社会需求的情报。所以专利情报的收集与利用贯穿于企业发展经营活动的全过程。在研究开发决策阶段专利情报战略的任务是支持企业对研究与开发方案的决策;在新技术开发研究阶段是提供技术依据;在新产品生产经营阶段则是分析研究专利法律、经济情报,研究专利权的取得、维护和使用,保护国内市场,占领国际市场,保护企业的工业产权不受侵害。由此可见,专利情报战略对于企业具有何等重要的意义。
