一、劳务派遣行业范围之限制面对当前劳动力市场存在的用人单位为转移用工风险、规避劳动法律责任而刻意泛化劳务派遣适用范围的现象,对劳务派遣的范围应当加以限制。当今用人单位的滥用劳务派遣行为,源于《劳动合同法》对劳务派遣的适用范围是采用概括式立法的方式,造成各界对劳务派遣范围的临时性、辅助性、替代性理解不一。即便是《〈劳动合同法〉实施条例》草案第38条,对《劳动合同法》中劳务派遣界定模糊的情形给予了限定解释,但也有待于进一步商榷。
I. Limitation on the Scope of Labor Dispatching Industry In the face of the current labor market's existence of employing units to deliberately generalize the scope of labor dispatching in order to shift employment risks and avoid labor legal responsibilities, the scope of labor dispatch should be limited. The abuse of labor dispatch by employers today stems from the fact that the scope of application of Labor Contract Law to labor dispatching adopts the method of generalized legislation, which causes the different understandings of the temporary, auxiliary and alternative of the scope of labor dispatch. Even Article 38 of the Draft Implementation Regulations of gives a limited interpretation of the ambiguity in the definition of labor dispatch in the “Labor Contract Law,” but it still needs further discussion.
