为了规范质量技术监督行政处罚程序,保障质量技术监督部门有效实施行政管理,保护公民、法人和其他组织的合法权益,国家质检总局近日公布了《质量技术监督行政处罚程序规定》,自2011年7月1日起施行。该规定共分八章六十五条,包括行政处罚的一般程序、行政处罚的听证程序、行政处罚的简易程序、行政处罚的执行和结案等,其施行之日,原国家技术监督局公布的《技术监督行政案件办理程序的规定》、《技术监督行政案件现场处罚规定》、《技术监督行政案件听证工作规则》同时废止。现将新规定的主要内容刊登如下,供读者参考。
In order to standardize the quality and technical supervision of administrative penalty procedures, to ensure the effective implementation of quality and technical supervision departments to carry out administrative management and protect the legitimate rights and interests of citizens, legal persons and other organizations, the AQSIQ recently promulgated the “Regulations on Quality and Technical Supervision Administrative Punishment Procedures” since 2011 July 1 will come into effect. The provisions are divided into eight chapters and sixty-five, including the general procedures for administrative punishment, administrative penalty hearing procedures, summary procedures for administrative penalties, the implementation of administrative penalties and case closed, the implementation of the date, the former State Bureau of Technical Supervision announced “Provisions on Handling Procedures for Administrative Supervision of Technical Supervision”, “Provisions on Site Punishment for Technical Supervision Administrative Cases” and “Rules for Hearings of Technical Supervision Administrative Cases” shall be abolished at the same time.
