行政机关在行政复议中可能作出不利于他人的决定时,如没有采取适当的方式通知其本人参加行政复议即作出复议决定的,构成严重违反法定程序,应予撤销。
When an administrative organ may make a decision that is detrimental to others in administrative reconsideration, it shall be revoked if it does not take the proper form to notify itself of the reconsideration decision in administrative reconsideration, which constitutes a serious violation of legal procedures.
